1. Nature of RenterFinder Platform

RenterFinder.com ("Platform," "Portal," "Website," "we," "us," "our") is a technology-enabled online intermediary platform operated by VAMY Properties Pvt. Ltd, headquartered in Patna, Bihar, India, and founded in 2025. The Platform is NOT a real estate broker, real estate agent, managing broker, property dealer, or any form of licensed real estate professional. We charge a non-brokerage "Platform Service Fee" for our tech-based listing, data curating, coordination, moderation and matchmaking services.

1.1 Services Provided
RenterFinder provides technology-based matching and communication services that facilitate connections between landlords and prospective renters ("Users") in India. The Platform's services include:

• Profile hosting and listing services for landlords and renters
• Technology-enabled matching algorithms to connect Users based on preferences and requirements
• Secure messaging and communication infrastructure between Users
• Automated content moderation using AI and machine learning systems
• Fraud detection and user safety mechanisms
• Payment processing services through third-party payment gateways

1.2 What We Do NOT Provide
RenterFinder. explicitly disclaims the following:

• We do not act as a real estate broker or agent
• We do not conduct property inspections or valuations
• We do not verify property ownership, title, or legal status
• We do not negotiate rent, lease terms, or agreements on behalf of Users
• We do not conduct thorough background checks or character assessments
• We do not provide legal advice or contract drafting services
• We do not provide property insurance or tenant insurance
• We do not guarantee property condition, maintenance standards, or habitability
• We do not mediate disputes between landlords and renters
• We do not collect, hold, or manage security deposits, rent or maintenance charges

1.3 User Relationship
Users engage with the Platform and with each other as independent parties. RenterFinder is not a party to any rental agreement, lease, tenancy contract, or transaction conducted between Users. All agreements relating to property rental are exclusively between the landlord and renter and are governed by the laws of the relevant state/jurisdiction where the property is located.

2. Automated Systems and Artificial Intelligence Disclaimer

CRITICAL DISCLAIMER: This section is essential and governs the use of automated systems on the Platform.

2.1 Employment of Automated Systems
The Platform employs automated tools, including artificial intelligence and machine learning-based systems ("Automated Systems"), for the purposes of content moderation, communication monitoring, fraud detection, spam filtering, pattern recognition, user safety enforcement, and violation detection. You acknowledge and agree to the following:

2.2 Inherent Limitations of Automated Systems
(a) Imperfection and Error: Automated Systems are not infallible and are inherently prone to both false positives and false negatives. The Platform does not warrant that Automated Systems will function without error or achieve perfect accuracy in any aspect of their operation.
(b) Detection Failures: The Platform does not guarantee that all prohibited, harmful, fraudulent, illegal, defamatory, abusive, obscene, or objectionable content that violates the Platform's Terms of Service or applicable law will be detected, flagged, restricted, or removed by Automated Systems.
(c) Incorrect Flagging: The Platform does not guarantee that lawful, non-prohibited, and appropriate content will not be incorrectly flagged, restricted, removed, or suspended by Automated Systems. Users acknowledge that false positives may occur and that legitimate content may be incorrectly identified as prohibited.
(d) Absence of Comprehensive Human Review: No human review occurs for every individual communication, message, image, or content processed by Automated Systems. While the Platform may conduct human review of flagged content or user appeals, this review is not systematic, comprehensive, or guaranteed for all items processed by Automated Systems.
(e) No Liability for Moderation Failures: The Platform bears no liability, responsibility, or obligation for (i) any prohibited or harmful content that escapes Automated Systems detection and moderation; (ii) any lawful content that is incorrectly flagged or suspended by Automated Systems; (iii) temporary or permanent content removal decisions; (iv) account suspension or termination; or (v) any damages, losses, or consequences arising from moderation decisions made by Automated Systems or Platform staff.
(f) No Duty of Care or Safety Warranty: Users acknowledge that they interact/engage with Platform or each other entirely at their own risk and assume full responsibility for their own safety, security, and legal compliance. The existence of Automated Systems and moderation mechanisms does not create any duty of care, warranty, guarantee of safety, duty to protect, fiduciary duty, or obligation to ensure that harmful interactions do not occur.
(g) Communication Processing and Storage: Automated Systems may process, analyze, scan, store, and review communications (including text messages, images, documents, and metadata) for moderation, safety, and compliance purposes. This processing occurs in compliance with applicable data protection laws and the Platform's Privacy Policy. By using the Platform, you consent to this processing.

2.3 Availability and Updates
The Platform may update, modify, disable, or discontinue Automated Systems at any time without notice or liability. The effectiveness and accuracy of Automated Systems may vary over time due to technical updates, algorithm changes, or other factors beyond the Platform's control.

3. Comprehensive Liability Exclusions and Limitations

To the maximum extent permitted by law, RenterFinder explicitly excludes and disclaims liability for all of the following:

3.1 Primary Exclusions

• Off-Platform Communications: Any communications, transactions, exchanges, payments, or agreements that occur outside the Platform, including via WhatsApp, phone calls, email, in-person meetings, bank transfers, cash payments, or any other medium not controlled by the Platform
• Off-Platform Transactions: Any rental transactions, security deposit exchanges, financial transactions, mode of payment, or property-related agreements concluded outside the Platform are entirely between Users and outside the Platform's scope of liability
• Property Condition and Habitability: The condition of any rental property, including but not limited to structural integrity, cleanliness, maintenance status, compliance with building codes, water/electricity supply, plumbing, sanitation, pest control, air quality, natural light, safety standards, or fitness for human habitation
• Property Title and Legal Status: The legal ownership, title, encumbrances, mortgages, liens, disputes, or any legal claims against any property listed on the Platform; the Platform does not verify ownership and disclaims all responsibility for title disputes
• Rent Agreement Disputes: Any disputes, disagreements, breaches, or conflicts arising from rental agreements, lease terms, tenancy contracts, rent payment obligations, or any contractual arrangements between Users
• Dispute on Vacation of Property: Any dispute arises due to failure or refusal of renter to vacate the property upon the expiry or lawful termination of the rental period
• Security Deposit Disputes: Claims, disputes, or conflicts regarding security deposits, including non-return, partial return, deductions, or disagreements about deposit amounts; Users must address these directly with each other or through legal proceedings
• Maintenance and Repair Obligations: Any disputes regarding maintenance responsibilities, repair obligations, renovation standards, damage claims, or landlord/renter maintenance disagreements arising during or after tenancy
• Neighbor and Society Disputes: Disputes with neighbors, residential societies, housing associations, municipal corporations, or any issues arising from society rules, neighbor relations, or community conflicts
• Police Verification Failures: Any delays, errors, inaccuracies, incomplete results, or failures by police authorities in conducting police verifications; the Platform is not responsible for police conduct or verification accuracy
• Background Check Inaccuracies: Any errors, omissions, inaccuracies, or incompleteness in background checks / character verification conducted by third-party providers; the Platform disclaims liability for third-party provider errors
• Loss of Opportunity: Loss of rental opportunities, missed listings, inability to find suitable accommodation or tenants, market changes, or any opportunity costs
• Emotional Distress: Any emotional distress, psychological harm, reputational damage, mental anguish, or non-pecuniary losses arising from Platform use or interactions with other Users
• Internet and Connectivity Issues: Any technical failures, internet outages, server downtime, connectivity problems, latency, bandwidth limitations, or network disruptions affecting Platform access or functionality
• Mobile Application Crashes: Any crashes, freezes, bugs, glitches, data loss, or technical failures in the RenterFinder mobile application or web platform
• Data Loss During Transmission: Loss, corruption, or deletion of data during transmission through the internet, email, SMS, or any digital channel; the Platform does not guarantee data integrity during transmission
• Third-Party Payment Gateway Failures: Any failures, delays, errors, fraud, unauthorized transactions, or disputes involving third-party payment gateways used for fee collection, platform charges, or user payments
• Tax Implications: Any tax consequences, Goods and Services Tax (GST) implications, income tax liabilities, rental income reporting obligations, or other tax-related matters arising from transactions facilitated by the Platform; Users must consult tax professionals
• Insurance Claims: Any insurance-related claims, disputes, denials, or coverage issues arising from rental transactions or properties facilitated through the Platform; Users must obtain appropriate insurance independently
• Death or Personal Injury: To the maximum extent permitted by law, the Platform disclaims liability for death, personal injury, bodily harm, or any physical harm to any person arising from Platform use, User interactions, or property conditions
• Consequential and Indirect Damages: Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, lost revenue, lost business opportunity, lost data, or business interruption
• Unauthorized arrangements: Any verbal or written commitments, representations or understandings between users or any third party outside the platform.
• Engagement of Property Agent: Engagement of property broker by users, terms of engagement, fees, commissions or charge levied by such brokers
• Misconduct by User: Any act of misconduct, negligence, misrepresentation or unlawful behavior by any user at any point of time, during or after the use of our services
• Termination and Suspension: We reserve the right to suspend, restrict or terminate your access to your profile and /or the Services at our sole discretion, with or without notice, for any reason. We shall not be liable for any losses or damages resulting from the suspension or termination of your account or access to the Services.
• Verification of Information: Any verification or warrant for the accuracy, authenticity, completeness or legality of any information provided by Users at the Platform. Users are solely responsible for conducting independent due diligence and verifying all information prior to entering into any agreements or transactions.
• Expectations: Any warranties that our Services will meet the specific requirements, expectations or objectives of any User. That the access to Services will be continuous, uninterrupted, timely, secure or free from errors, defects, or vulnerabilities. That any information, results or outputs obtained through the use of the Servies will be accurate, complete, reliable or fit for any particular purpose.
• Endorsement: The Platform may contain links to third-party websites, advertisements or services. So, any endorsement, control or responsibility for the accuracy or legality of such content.
• Affiliation: Affiliation with any govt. authority, NGO, real estate agency or property management entity unless expressly stated otherwise.

3.2 Limitation of Liability
Even if RenterFinder is advised of the possibility of damages, under no circumstances shall the Platform's total liability to any User exceed the total amount of fees paid by such User to the Platform in the twelve (12) months preceding the claim, or ₹1000 (One Thousand Rupees), whichever is less.

3.3 "AS-IS" Disclaimer
The Platform and all services, features, content, and User-generated content are provided on an "AS-IS" and "AS-AVAILABLE" basis without any warranties, guarantees, or representations of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, title, or any other warranty.

3.4 Intellectual Property Rights
All intellectual property rights in the Services, including but not limited to trademarks, logos, designs, software, source code, database, and original content are owned by RenterFinder and its licensors. Unauthorized use, reproduction, modification, or distribution of such materials is strictly prohibited and may result in legal action.

3.5 User Generated Content
By submitting content (e.g. listings, profiles, reviews, messages, photos, etc) to the Platform, you grant us a non-exlusive, irrevocable, perpetual, royalty free, worldwise license to use, reproduce, modify, display and distribute such content for purposes related to the operation, promotion and improvement of the Services

4. RERA Non-Applicability and Regulatory Status

4.1 Why RERA Does Not Apply to RenterFinder
RenterFinder is NOT subject to the Real Estate Regulation and Development Act, 2016 ("RERA"). The reasons are as follows:

4.2 RenterFinder is Not a Real Estate Project or Promoter
RERA applies to real estate "projects" developed by "promoters" who are engaged in the business of developing real estate for sale or lease. RenterFinder does not develop, construct, or promote any real estate projects. The Platform merely facilitates connections between independent landlords and renters through technology. RenterFinder owns no properties, develops no properties, and is not engaged in real estate development.

4.3 Technology Intermediary, Not Real Estate Business
Under RERA Section 2(d) and related sections, the Act applies to persons engaged in the "business" of selling or leasing real estate projects. RenterFinder's business is technology-enabled matching, not real estate sales or leasing. The Platform does not buy, sell, or lease properties; it provides technology infrastructure for peer-to-peer connections.

4.4 RERA Applicability Reference
For detailed information on RERA applicability, scope, and exemptions, Users are encouraged to review:

• The Real Estate Regulation and Development Act, 2016 (Central Act)
• State-specific RERA Rules and Regulations
• RERA Sections 2(d), 2(i), 2(j), 2(zd), 2(zf) defining "project," "promoter," and excluded entities

4.6 User Responsibility for Compliance
While RERA does not apply to RenterFinder as a platform intermediary, individual landlords and renters may have RERA-related obligations depending on the state, property type, and transaction value. Users are solely responsible for understanding and complying with all applicable state laws, including RERA provisions in their jurisdiction.

5. Consumer Protection Act 2019 - Intermediary Status

5.1 RenterFinder's Service Category
Under the Consumer Protection Act, 2019 ("CPA 2019"), RenterFinder is an intermediary service provider offering technology-enabled matching services, not a traditional "service provider" offering services directly to consumers. The Platform facilitates peer-to-peer connections but does not provide rental services, property management services, or any direct services to Users.

5.2 Technology-Based Matching Service
RenterFinder's core service is a technology-based platform that matches landlords with prospective renters based on preferences, location, budget, and other criteria. This is a technology intermediary service, not a service that guarantees outcomes, rental agreements, or successful transactions.

5.3 No Warranty of Outcome
RenterFinder provides no warranty that Users will successfully find accommodation, rent out their properties, negotiate acceptable terms, or conclude transactions. The Platform guarantees only the availability and functionality of its matching technology. The success or failure of any rental transaction depends entirely on the Users involved and circumstances beyond the Platform's control.

5.4 CPA 2019 Complaint Redressal
While RenterFinder is committed to resolving User concerns through its own complaint redressal process, please note that CPA 2019 consumer complaint procedures may have limited applicability to technology-based intermediary services. For disputes related to rental agreements, property conditions, or off-platform transactions, Users should pursue remedies through civil courts or arbitration, not consumer courts.

5.5 Intermediary vs. Direct Service Provider
RenterFinder is not directly providing rental accommodations, property management, or landlord/renter services. Users engage with each other, and RenterFinder's role is limited to coordination, matching, and communication facilitation. This distinction is important for understanding the limits of CPA 2019 applicability.

6. Data Protection and Privacy

6.1 DPDP Act Compliance
RenterFinder processes personal data in compliance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"). Personal data processing during content moderation, fraud detection, and user safety enforcement is conducted under the "legitimate use" and "lawful basis" provisions of the DPDP Act.

6.2 Automated Processing and Consent
By using the Platform, you consent to the processing of your personal data (including communications, metadata, profile information, and usage patterns) by Automated Systems for moderation, safety, and compliance purposes. This processing is conducted in compliance with applicable data protection laws.

6.3 Privacy Policy Reference
For comprehensive information regarding how RenterFinder collects, uses, stores, and protects your personal data, please refer to the Platform's Privacy Policy. The Privacy Policy contains detailed information about:

• Types of personal data collected
• Purposes of data processing
• Data retention periods
• Your rights under DPDP Act and other laws
• Data security measures
• Third-party data sharing
• Data deletion procedures

In case of any conflict between this Disclaimer and the Privacy Policy regarding data protection, the Privacy Policy shall govern data-related matters.

6.4 Temporary Data Storage
Personal data and communications processed by Automated Systems may be temporarily stored for moderation analysis and safety purposes. This storage complies with data protection requirements and is subject to deletion timelines specified in the Privacy Policy.

7. Information Technology Act Safe Harbour Provisions

7.1 Section 79 Intermediary Protection
RenterFinder operates as an "intermediary" under the Information Technology Act, 2000 ("IT Act"). Under Section 79 of the IT Act, intermediaries that comply with prescribed due diligence requirements are not liable for third-party user-generated content. RenterFinder complies with Section 79 requirements including:

• Prompt removal of prohibited content upon notification or discovery
• Maintenance of user records and compliance with user authentication requirements
• No knowledge of specific unlawful content before transmitting it
• No intentional inducement of unlawful activities
• Maintenance of prescribed privacy and security standards

7.2 IT Act (Intermediary Guidelines) Rules 2021 Compliance
RenterFinder complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), including:

• Grievance Redressal: A designated Grievance Officer for addressing user complaints
• Terms of Service: Clear terms governing user conduct and prohibited content
• User Identification: Mechanisms for identifying users while protecting privacy
• Proactive Monitoring: Automated tools for detecting and removing prohibited content
• Transparency Report: Regular publication of data on complaints received and action taken
• Harmful Content Removal: Removal of content that is illegal, defamatory, abusive, or violates user privacy

7.3 2026 Amendment Compliance
RenterFinder acknowledges and complies with all amendments to the IT Act, IT Rules 2021, and related regulations as of April 2026. The Platform maintains an updated Grievance Redressal process and compliance procedures in accordance with the latest regulatory framework.

7.4 Intermediary Liability Limitations
To the extent permitted by Section 79 of the IT Act, RenterFinder's liability for user-generated content is limited to:

• Removal of content upon receipt of valid legal notice or court order
• Removal of content discovered through proactive moderation
• No liability for content that escapes moderation despite reasonable efforts
• No liability for user interactions, transactions, or off-platform conduct

8. Additional Disclaimers and Warranties

8.1 Financial and Investment Disclaimer
RenterFinder does not provide financial advice, investment advice, or recommendations regarding rental yield, return on investment, property appreciation, or financial outcomes. Any information provided regarding rental markets, pricing, or financial metrics is for informational purposes only and should not be relied upon for financial decision-making. Users must consult independent financial advisors, tax professionals, and real estate consultants for financial planning.

RenterFinder disclaims all liability for financial losses, investment losses, opportunity costs, or adverse financial outcomes arising from decisions made based on Platform information or market data.

8.2 Legal Advice Disclaimer
RenterFinder does not provide legal advice regarding rental agreements, tenancy laws, lease terms, dispute resolution, or any legal matters. The Platform does not provide legal counsel or guidance on Model Tenancy Act, 2021, state rental laws, consumer protection statutes, or any other legal matters.

Users must consult qualified legal professionals for legal advice regarding:

• Drafting or reviewing rental agreements and leases
• Compliance with state rental laws and the Model Tenancy Act, 2021
• Tenant rights and landlord obligations
• Security deposit regulations and dispute resolution
• Eviction procedures and legal remedies
• Consumer protection laws and tenant protection statutes

8.3 Tax Advice Disclaimer
RenterFinder does not provide tax advice, tax planning services, or guidance on rental income taxation, GST compliance, property tax obligations, or income tax requirements. Users must consult qualified tax professionals (Chartered Accountants, tax consultants) for tax-related matters including:

• Income tax implications of rental income
• Goods and Services Tax (GST) registration and compliance
• Deductibility of rental expenses and maintenance costs
• Depreciation and property tax considerations
• Tax planning strategies for rental properties
• Filing requirements and compliance obligations

8.4 Market Conditions and Rental Yield Disclaimer
Rental market conditions, pricing, demand, supply, and rental yields are subject to continuous change. RenterFinder provides information on market trends for informational purposes only. The Platform does not guarantee market conditions, rent levels, or rental demand. Market fluctuations, economic cycles, policy changes, and unforeseen events may significantly impact rental markets and user outcomes.

Users acknowledge that rental investment decisions carry inherent market risks and that historical market performance does not guarantee future results.

8.5 Force Majeure
RenterFinder shall not be liable for any failure to perform its obligations under these Terms due to causes beyond reasonable control, including:

• Natural disasters, earthquakes, floods, hurricanes, or severe weather
• Pandemics, epidemics, or public health emergencies
• War, terrorism, civil unrest, or government action
• Strikes, labor disputes, or force majeure labor events
• Internet infrastructure failures beyond the Platform's control
• Government-mandated internet shutdowns or regulatory actions
• Power outages or utility service interruptions
• Third-party payment gateway or service provider failures

The Platform shall provide notice of force majeure events to the extent reasonably possible and shall resume services as soon as practicable after the event concludes.

8.6 Payment Fraud Advisory
CRITICAL SECURITY NOTICE: Users must be aware of potential payment fraud, scams, and unauthorized transactions. RenterFinder strongly advises:

• Use only official RenterFinder payment channels through our secure payment gateway to pay Profile Listing Fee and Platform Service Fee
• Beware of scams requesting payment through fraudulent communications i.e phone calls, messages, emails etc purporting to represent or be affiliated with RenterFinder.
• Verify the authenticity of all communications referencing RenterFinder before making any urgent payment or disclosing any financial information or time-sensitive deals
• We will not be held liable for any financial loss or damage due to any transactions outside our platform channels among renter, landlord, third-party consultants, property agents, any other person involved or otherwise
• Never share bank account numbers, UPI IDs, OTP or payment credentials with any unverified or unknown Users
• Report suspected fraud immediately to report@renterfinder.com with evidence and details

RenterFinder does not guarantee protection against fraud, and Users engage at their own risk. The Platform shall not be liable for fraud, scams, or unauthorized transactions involving Users.

8.7 Communication Delivery Disclaimer
RenterFinder does not guarantee the delivery, timeliness, or receipt of email messages, SMS notifications, push notifications, or in-app messages. Users should not rely on communication delivery guarantees. Due to network issues, ISP limitations, spam filters, or carrier issues, important messages may not reach their intended recipient.

Users should periodically check the Platform directly for important information rather than relying solely on email or SMS notifications. RenterFinder is not liable for missed communications or failure to receive notifications.

9. User Responsibilities and Risk Acknowledgement

9.1 User Acknowledgement of Risks
By using RenterFinder, you expressly acknowledge and agree that:

• You use the Platform entirely at your own risk
• You assume all risks associated with finding rental accommodation or tenants
• You assume all risks associated with interactions with other Users
• You assume all risks of fraud, scams, misrepresentation, or harmful conduct by other Users
• You assume all risks associated with property condition, title, legality, and habitability
• You assume responsibility for conducting independent due diligence on properties and Users
• You assume all risks of agreements, transactions, and arrangements with other Users

9.2 User Due Diligence Obligations
Users must conduct comprehensive independent due diligence before concluding any rental transaction, including:

• Identity Verification: Independently verify the identity, credentials, and authenticity of landlords or renters before providing personal information or money
• Property Verification: Conduct in-person property inspections, verify legal ownership, check for encumbrances, liens, or disputes
• Background Checks: Conduct independent background checks or character verification through trusted third parties, not relying on Platform verifications alone
• Agreement Review: Have rental agreements and lease terms reviewed by qualified legal professionals before signing
• Financial Investigation: Conduct credit and financial checks on renters or landlords through independent channels
• Reference Checks: Independently contact and verify references provided by other Users
• Market Research: Conduct independent market research on rental rates, comparable properties, and market conditions

9.3 No Reliance on Platform Information
Users should not rely solely on information provided through the Platform, including User profiles, photos, descriptions, verification status, or background check results. This information may be incomplete, inaccurate, outdated, or fraudulent. All critical decisions must be based on independent verification and due diligence.

9.4 Independent Consultation Requirements
Before concluding any transaction, Users must independently consult with:

• Qualified legal professionals for contract review and legal compliance
• Qualified financial advisors and tax professionals for financial implications
• Licensed property inspectors or engineers for property condition assessment
• Real estate professionals for market analysis and property valuation
• Insurance professionals for appropriate insurance coverage
• Government authorities for regulatory compliance and legal requirements

9.5 Assumption of Risk
By using the Platform and engaging in transactions through or in connection with the Platform, you expressly assume all risks and waive all claims against RenterFinder for any harm, loss, damage, or adverse outcome arising from your use of the Platform or your interactions with other Users.

10. Indemnification and Governing Law

10.1 Indemnification by Users

• Your violation of these Terms or any applicable law
• Your transactions with other Users
• Your breach of any rental agreement or contract
• Any claims by third parties regarding your conduct
• Your non-compliance with applicable laws and regulations
• Any property damage, personal injury, or death arising from your actions
• Any fraud, misrepresentation, or illegal conduct by you

10.2 Governing Law and Jurisdiction
These Terms and this Disclaimer shall be governed by and construed in accordance with the laws of the State of Bihar, India, without regard to its conflict of law principles. The exclusive jurisdiction for any legal proceedings, disputes, or claims arising out of or related to this Disclaimer or the Platform shall be the District Courts in Patna, Bihar, India.

By using the Platform, Users agree to submit to the exclusive jurisdiction of the courts in Patna, Bihar, and waive any objections based on forum non conveniens or any other jurisdictional grounds.

10.3 Severability

This Disclaimer, together with the Platform's Terms of Service and Privacy Policy, constitutes the entire agreement between you and RenterFinder regarding the Platform's services and disclaims all prior representations, warranties, and agreements, whether written or oral.

10.6 Waiver
No waiver of any provision or right under this Disclaimer shall be effective unless in writing and signed by a representative of RenterFinder. The failure of RenterFinder to enforce any provision does not constitute a waiver of that provision or any other provision.
