RenterFinder.com ("Platform," "Portal," "Website," "we," "us," "our") is a technology-enabled online intermediary platform operated by VAMY Properties Pvt. Ltd, headquartered in Patna, Bihar, India, and founded in 2025. The Platform is NOT a real estate broker, real estate agent, managing broker, property dealer, or any form of licensed real estate professional. We charge a non-brokerage "Platform Service Fee" for our tech-based listing, data curating, coordination, moderation and matchmaking services.
1.1 Services Provided
RenterFinder provides technology-based matching and communication services that facilitate connections between landlords and prospective renters ("Users") in India. The Platform's services include:

RenterFinder. explicitly disclaims the following:
1.3 User Relationship
Users engage with the Platform and with each other as independent parties. RenterFinder is not a party to any rental agreement, lease, tenancy contract, or transaction conducted between Users. All agreements relating to property rental are exclusively between the landlord and renter and are governed by the laws of the relevant state/jurisdiction where the property is located.
CRITICAL DISCLAIMER: This section is essential and governs the use of automated systems on the Platform.
2.1 Employment of Automated Systems
The Platform employs automated tools, including artificial intelligence and machine learning-based systems ("Automated Systems"), for the purposes of content moderation, communication monitoring, fraud detection, spam filtering, pattern recognition, user safety enforcement, and violation detection. You acknowledge and agree to the following:
2.2 Inherent Limitations of Automated Systems
(a) Imperfection and Error: Automated Systems are not infallible and are inherently prone to both false positives and false negatives. The Platform does not warrant that Automated Systems will function without error or achieve perfect accuracy in any aspect of their operation.
(b) Detection Failures: The Platform does not guarantee that all prohibited, harmful, fraudulent, illegal, defamatory, abusive, obscene, or objectionable content that violates the Platform's Terms of Service or applicable law will be detected, flagged, restricted, or removed by Automated Systems.
(c) Incorrect Flagging: The Platform does not guarantee that lawful, non-prohibited, and appropriate content will not be incorrectly flagged, restricted, removed, or suspended by Automated Systems. Users acknowledge that false positives may occur and that legitimate content may be incorrectly identified as prohibited.
(d) Absence of Comprehensive Human Review: No human review occurs for every individual communication, message, image, or content processed by Automated Systems. While the Platform may conduct human review of flagged content or user appeals, this review is not systematic, comprehensive, or guaranteed for all items processed by Automated Systems.
(e) No Liability for Moderation Failures: The Platform bears no liability, responsibility, or obligation for (i) any prohibited or harmful content that escapes Automated Systems detection and moderation; (ii) any lawful content that is incorrectly flagged or suspended by Automated Systems; (iii) temporary or permanent content removal decisions; (iv) account suspension or termination; or (v) any damages, losses, or consequences arising from moderation decisions made by Automated Systems or Platform staff.
(f) No Duty of Care or Safety Warranty: Users acknowledge that they interact/engage with Platform or each other entirely at their own risk and assume full responsibility for their own safety, security, and legal compliance. The existence of Automated Systems and moderation mechanisms does not create any duty of care, warranty, guarantee of safety, duty to protect, fiduciary duty, or obligation to ensure that harmful interactions do not occur.
(g) Communication Processing and Storage: Automated Systems may process, analyze, scan, store, and review communications (including text messages, images, documents, and metadata) for moderation, safety, and compliance purposes. This processing occurs in compliance with applicable data protection laws and the Platform's Privacy Policy. By using the Platform, you consent to this processing.
2.3 Availability and Updates
The Platform may update, modify, disable, or discontinue Automated Systems at any time without notice or liability. The effectiveness and accuracy of Automated Systems may vary over time due to technical updates, algorithm changes, or other factors beyond the Platform's control.
To the maximum extent permitted by law, RenterFinder explicitly excludes and disclaims liability for all of the following:

Even if RenterFinder is advised of the possibility of damages, under no circumstances shall the Platform's total liability to any User exceed the total amount of fees paid by such User to the Platform in the twelve (12) months preceding the claim, or ₹1000 (One Thousand Rupees), whichever is less.
3.3 "AS-IS" Disclaimer
The Platform and all services, features, content, and User-generated content are provided on an "AS-IS" and "AS-AVAILABLE" basis without any warranties, guarantees, or representations of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, title, or any other warranty.
3.4 Intellectual Property Rights
All intellectual property rights in the Services, including but not limited to trademarks, logos, designs, software, source code, database, and original content are owned by RenterFinder and its licensors. Unauthorized use, reproduction, modification, or distribution of such materials is strictly prohibited and may result in legal action.
3.5 User Generated Content
By submitting content (e.g. listings, profiles, reviews, messages, photos, etc) to the Platform, you grant us a non-exlusive, irrevocable, perpetual, royalty free, worldwise license to use, reproduce, modify, display and distribute such content for purposes related to the operation, promotion and improvement of the Services
4.1 Why RERA Does Not Apply to RenterFinder
RenterFinder is NOT subject to the Real Estate Regulation and Development Act, 2016 ("RERA"). The reasons are as follows:
4.2 RenterFinder is Not a Real Estate Project or Promoter
RERA applies to real estate "projects" developed by "promoters" who are engaged in the business of developing real estate for sale or lease. RenterFinder does not develop, construct, or promote any real estate projects. The Platform merely facilitates connections between independent landlords and renters through technology. RenterFinder owns no properties, develops no properties, and is not engaged in real estate development.
4.3 Technology Intermediary, Not Real Estate Business
Under RERA Section 2(d) and related sections, the Act applies to persons engaged in the "business" of selling or leasing real estate projects. RenterFinder's business is technology-enabled matching, not real estate sales or leasing. The Platform does not buy, sell, or lease properties; it provides technology infrastructure for peer-to-peer connections.
4.4 RERA Applicability Reference

4.6 User Responsibility for Compliance
While RERA does not apply to RenterFinder as a platform intermediary, individual landlords and renters may have RERA-related obligations depending on the state, property type, and transaction value. Users are solely responsible for understanding and complying with all applicable state laws, including RERA provisions in their jurisdiction.
5.1 RenterFinder's Service Category
Under the Consumer Protection Act, 2019 ("CPA 2019"), RenterFinder is an intermediary service provider offering technology-enabled matching services, not a traditional "service provider" offering services directly to consumers. The Platform facilitates peer-to-peer connections but does not provide rental services, property management services, or any direct services to Users.
5.2 Technology-Based Matching Service
RenterFinder's core service is a technology-based platform that matches landlords with prospective renters based on preferences, location, budget, and other criteria. This is a technology intermediary service, not a service that guarantees outcomes, rental agreements, or successful transactions.
5.3 No Warranty of Outcome
RenterFinder provides no warranty that Users will successfully find accommodation, rent out their properties, negotiate acceptable terms, or conclude transactions. The Platform guarantees only the availability and functionality of its matching technology. The success or failure of any rental transaction depends entirely on the Users involved and circumstances beyond the Platform's control.
5.4 CPA 2019 Complaint Redressal
While RenterFinder is committed to resolving User concerns through its own complaint redressal process, please note that CPA 2019 consumer complaint procedures may have limited applicability to technology-based intermediary services. For disputes related to rental agreements, property conditions, or off-platform transactions, Users should pursue remedies through civil courts or arbitration, not consumer courts.
5.5 Intermediary vs. Direct Service Provider
RenterFinder is not directly providing rental accommodations, property management, or landlord/renter services. Users engage with each other, and RenterFinder's role is limited to coordination, matching, and communication facilitation. This distinction is important for understanding the limits of CPA 2019 applicability.
6.1 DPDP Act Compliance
RenterFinder processes personal data in compliance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"). Personal data processing during content moderation, fraud detection, and user safety enforcement is conducted under the "legitimate use" and "lawful basis" provisions of the DPDP Act.
6.2 Automated Processing and Consent
By using the Platform, you consent to the processing of your personal data (including communications, metadata, profile information, and usage patterns) by Automated Systems for moderation, safety, and compliance purposes. This processing is conducted in compliance with applicable data protection laws.
6.3 Privacy Policy Reference

6.4 Temporary Data Storage
Personal data and communications processed by Automated Systems may be temporarily stored for moderation analysis and safety purposes. This storage complies with data protection requirements and is subject to deletion timelines specified in the Privacy Policy.
7.1 Section 79 Intermediary Protection
RenterFinder operates as an "intermediary" under the Information Technology Act, 2000 ("IT Act"). Under Section 79 of the IT Act, intermediaries that comply with prescribed due diligence requirements are not liable for third-party user-generated content. RenterFinder complies with Section 79 requirements including:

RenterFinder disclaims all liability for financial losses, investment losses, opportunity costs, or adverse financial outcomes arising from decisions made based on Platform information or market data.
8.2 Legal Advice Disclaimer
RenterFinder does not provide legal advice regarding rental agreements, tenancy laws, lease terms, dispute resolution, or any legal matters. The Platform does not provide legal counsel or guidance on Model Tenancy Act, 2021, state rental laws, consumer protection statutes, or any other legal matters.
Users must consult qualified legal professionals for legal advice regarding:
8.3 Tax Advice Disclaimer
RenterFinder does not provide tax advice, tax planning services, or guidance on rental income taxation, GST compliance, property tax obligations, or income tax requirements. Users must consult qualified tax professionals (Chartered Accountants, tax consultants) for tax-related matters including:
8.4 Market Conditions and Rental Yield Disclaimer
Rental market conditions, pricing, demand, supply, and rental yields are subject to continuous change. RenterFinder provides information on market trends for informational purposes only. The Platform does not guarantee market conditions, rent levels, or rental demand. Market fluctuations, economic cycles, policy changes, and unforeseen events may significantly impact rental markets and user outcomes.
Users acknowledge that rental investment decisions carry inherent market risks and that historical market performance does not guarantee future results.
8.5 Force Majeure
RenterFinder shall not be liable for any failure to perform its obligations under these Terms due to causes beyond reasonable control, including:
The Platform shall provide notice of force majeure events to the extent reasonably possible and shall resume services as soon as practicable after the event concludes.
8.6 Payment Fraud Advisory
CRITICAL SECURITY NOTICE: Users must be aware of potential payment fraud, scams, and unauthorized transactions. RenterFinder strongly advises:
RenterFinder does not guarantee protection against fraud, and Users engage at their own risk. The Platform shall not be liable for fraud, scams, or unauthorized transactions involving Users.
8.7 Communication Delivery Disclaimer
RenterFinder does not guarantee the delivery, timeliness, or receipt of email messages, SMS notifications, push notifications, or in-app messages. Users should not rely on communication delivery guarantees. Due to network issues, ISP limitations, spam filters, or carrier issues, important messages may not reach their intended recipient.
Users should periodically check the Platform directly for important information rather than relying solely on email or SMS notifications. RenterFinder is not liable for missed communications or failure to receive notifications.
9.1 User Acknowledgement of Risks
By using RenterFinder, you expressly acknowledge and agree that:

Before concluding any transaction, Users must independently consult with:

By using the Platform and engaging in transactions through or in connection with the Platform, you expressly assume all risks and waive all claims against RenterFinder for any harm, loss, damage, or adverse outcome arising from your use of the Platform or your interactions with other Users.
10.1 Indemnification by Users
You agree to indemnify, defend, and hold harmless RenterFinder, its officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
10.2 Governing Law and Jurisdiction
These Terms and this Disclaimer shall be governed by and construed in accordance with the laws of the State of Bihar, India, without regard to its conflict of law principles. The exclusive jurisdiction for any legal proceedings, disputes, or claims arising out of or related to this Disclaimer or the Platform shall be the District Courts in Patna, Bihar, India.
By using the Platform, Users agree to submit to the exclusive jurisdiction of the courts in Patna, Bihar, and waive any objections based on forum non conveniens or any other jurisdictional grounds.
10.3 Severability
If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
10.4 Amendment and Modification
RenterFinder reserves the right to amend, modify, or update this Disclaimer at any time without notice. Your continued use of the Platform following any modifications constitutes acceptance of the updated Disclaimer. Users are responsible for reviewing this Disclaimer periodically for updates.
10.5 Entire Agreement
This Disclaimer, together with the Platform's Terms of Service and Privacy Policy, constitutes the entire agreement between you and RenterFinder regarding the Platform's services and disclaims all prior representations, warranties, and agreements, whether written or oral.
10.6 Waiver
No waiver of any provision or right under this Disclaimer shall be effective unless in writing and signed by a representative of RenterFinder. The failure of RenterFinder to enforce any provision does not constitute a waiver of that provision or any other provision.
