1.1 Key Definitions
In this Agreement, the following terms shall have the meanings assigned to them:
"Agreement" means these Terms of Use, including all schedules, policies, and guidelines referenced herein.
"Automated Systems" means software, algorithms, artificial intelligence, machine learning systems, and other automated tools employed by the Platform for content moderation, chat monitoring, fraud detection, spam filtering, user safety, and related purposes, which operate without individual human review of each interaction.
"Content" means any data, text, images, videos, audio, messages, listings, profiles, communications, or other information uploaded, created, transmitted, or shared by Users on the Platform.
"Creator" means the User who originally creates or uploads Content.
"Landlord" means any User offering residential rental properties through the Platform.
"Platform" or "RenterFinder" or "We/Us/Our" means RenterFinder.com, a technology intermediary incorporated in Bihar, India, and its successors and assigns.
"Renter" or "Tenant" means any User seeking to rent residential properties through the Platform.
"Services" means the online intermediary services provided by the Platform, including the marketplace, communication tools, user profiles, property listings, and related features.
"User" means any individual or entity that accesses, registers on, or uses the Platform, including Landlords, Renters, and other visitors.
"Personal Data" has the meaning assigned under the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000.
2.1 Acceptance of Terms
By accessing, registering on, or using the Platform in any manner, you agree to be legally bound by this Terms of Use Agreement. If you do not agree to all terms contained herein, you must not use the Platform. Your use of the Platform constitutes your explicit acknowledgment and unconditional acceptance of every provision, including but not limited to the automated moderation systems described in Section 8.
2.2 Binding Effect
This Agreement creates a legally binding contract between you and RenterFinder. It is enforceable to the fullest extent permitted under the laws of India, specifically the laws of the State of Bihar.
2.3 Age Requirement
You represent and warrant that you are at least 18 years of age and capable of entering into binding agreements. If you are under 18, you must ask your parent or elders to use the Platform for you.
2.4 Authority
When you are accessing the Platform, you warrant that you are not be prohibited by any law, regulation or judicial order from owning, renting or transacting in properties in India.
2.5 Continuous Acceptance
Your continued use of the Platform following any modification to this Agreement constitutes your acceptance of the modified terms. We may update this Agreement at any time. The most recent version will always be available on the Platform. It is your responsibility to review updates regularly.
3.1 Intermediary Declaration
RenterFinder qualifies as an "intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000, providing services to Users. We are a technology platform that facilitates connections between Landlords and Renters and does not itself act as a real estate broker, agent, or service provider for any type of property rental transactions. We do not own, lease or hold any legal interest in the properties listed. We do not engage in any tenancy agreement as party, negotiations or transactions between users.
3.2 No Brokerage Function
RenterFinder does not act as a real estate broker, licensed agent, or property dealer. We are not subject to the Real Estate (Regulation and Development) Act, 2016 (RERA) or any brokerage licensing requirements. We are an intermediary connecting market participants and do not perform brokerage functions, property valuations, or transaction completion services.
3.3 IT Act Section 79 Safe Harbour
We conduct our operations in compliance with Section 79 of the Information Technology Act, 2000, and the IT (Intermediary Guidelines) Rules, 2021, as amended by the IT (Intermediary Guidelines) Amendment Rules, 2026. We implement reasonable security practices and information systems to protect User data and System integrity. We do not initiate the transmission of Content, select the recipients of Content, or select or modify the information contained in Content. We act purely as a neutral conduit for User-to-User interactions.
3.4 Due Diligence and Compliance
We comply with the due diligence requirements prescribed in Rule 3(1) of the IT (Intermediary Guidelines) Rules, 2021, including the prohibition of certain illegal activities and the prompt removal of flagged illegal Content. Our Automated Systems assist in identifying and escalating potentially illegal or harmful Content.
3.5 Government Authority Cooperation
We cooperate with government authorities and law enforcement as required by law and court orders. We maintain records of User activities and transactions to the extent required by applicable law.

RenterFinder provides an online intermediary platform that enables Users to:

While we strive to maintain continuous access to the Platform, we do not guarantee uninterrupted availability. The Platform may be subject to maintenance, upgrades, or temporary outages without notice. We are not liable for any inability to access or use the Platform.
4.4 Third-Party Integrations
The Platform may integrate with third-party services (such as payment gateways, WhatsApp, communication tools, etc.). Your use of such third-party services is governed by their respective terms and privacy policies. We are not responsible for third-party services or their operations.
5.1 Registration Requirements
To use the Platform, you must complete the registration process and create a User account. During registration, you must provide accurate, complete, and current information. You agree to maintain the accuracy of your profile information and update it as necessary.
5.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, including passwords and authentication tokens. You are fully responsible for all activities that occur under your account, whether or not you authorized them. You agree to immediately notify RenterFinder of any unauthorized access or security breach affecting your account.
5.3 Profile Listing Fee
Landlords must pay a Profile Listing Fee to activate and maintain their rental property listings on the Platform. The current Profile Listing Fee is ₹125 (discounted from the standard rate of ₹499). This fee applies per profile activation. Payment of the Profile Listing Fee does not guarantee that listings will receive views, enquiries, or result in rental transactions.
5.4 Re-activation Fee
If a Landlord's profile is suspended, deactivated, or removed due to policy violations, account inactivity, or non-payment, the Landlord must pay a Re-activation Fee of ₹99 to restore (within 6 months) the profile with necessary changes (if any).
5.5 Account Termination
You may request account termination by contacting report.renterfinder@gmail.com. RenterFinder may terminate or suspend your account at any time for any reason or no reason, with or without notice, including for violation of this Agreement or applicable law. Termination does not relieve you of any obligations incurred prior to termination.
5.6 No Multiple Accounts
You may not create or maintain multiple accounts. If we discover multiple accounts created by the same User, all such accounts may be suspended or terminated without refund.
6.1 Lawful Use
You agree to use the Platform only for lawful purposes and in accordance with all applicable laws, rules, regulations, and ordinances. You must comply with all local, state, and national laws governing rental transactions, tenant rights, landlord responsibilities, property disclosures, and fair housing practices.
6.2 Activities Strictly Prohibited
You agree not to:
Violation of this section may result in immediate account suspension or termination, removal of Content, and referral to law enforcement authorities.
6.3 Honest Communication
All information provided on property listings, user profiles, and communications must be accurate, truthful, and non-misleading. You agree not to engage in false advertising, misrepresentation of property conditions, or fraudulent statements about rental terms or occupancy history.
6.4 Respect for Others
You agree to treat all Users with respect and dignity. Communication and interactions must be professional and courteous. Abusive, threatening, or harassing behavior toward other Users will result in immediate account suspension or termination.
6.5 Anti-Money Laundering Awareness
You acknowledge that the Platform operates in compliance with India's anti-money laundering laws and regulations. You agree not to use the Platform for money laundering, any illegal transactions, or any activities designed to conceal the source or destination of funds. Suspicious transactions may be reported to the appropriate financial authorities.
7.1 Platform Intellectual Property
All intellectual property rights in and to the Platform, including but not limited to software, design, layout, graphics, logos, trademarks, and other elements, are the exclusive property of RenterFinder or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely as expressly permitted by this Agreement.
7.2 User Content Ownership
You retain all intellectual property rights in and to Content you create and upload. By uploading Content to the Platform, you grant RenterFinder a worldwide, non-exclusive, royalty-free, irrevocable license to use, reproduce, distribute, display, and transmit such Content for the purposes of operating the Platform, providing Services, and complying with legal obligations.
7.3 License Carve-Out for Data Erasure
Notwithstanding Section 7.2, the license granted to RenterFinder shall survive for archival, legal compliance, and record-keeping purposes. However, where Personal Data is subject to erasure rights under the Digital Personal Data Protection Act, 2023, RenterFinder shall erase such Personal Data as required by law, and the license shall not apply to erased data. RenterFinder retains the right to retain data in anonymized or de-identified form for analytical, research, and platform improvement purposes.
7.4 Feedback and Suggestions
Any feedback, suggestions, ideas, or other information you provide us regarding the Platform or Services may be used by RenterFinder without obligation or compensation to you.
7.5 Trademark and Brand Guidelines
You may not use RenterFinder's name, logos, trademarks, or branding materials without prior written permission. Unauthorized use of our intellectual property is prohibited.
8.1 Use of Automated Systems
You acknowledge and agree that the Platform employs automated tools, including artificial intelligence and machine learning-based systems ("Automated Systems"), to monitor, filter, flag, and moderate Content and communications on the Platform. This includes but is not limited to:
8.2 Automated Operation Without Human Review
Such Automated Systems operate without direct human oversight for each individual communication, interaction, or Content item. The Automated Systems may, at their sole discretion and based on algorithmic determinations, flag, restrict, remove, or escalate Content or communications that are determined to violate this Agreement, applicable law, or Platform safety standards. Decisions made by Automated Systems are final and binding unless you exercise the grievance redressal mechanism in Section 21.
8.3 Transparency Limitations
Due to the proprietary nature of our Automated Systems and the need to prevent circumvention of safety measures, we do not disclose the specific algorithms, rules, or criteria used for automated moderation. Details about our Automated Systems may be disclosed only as required by law or as part of formal legal proceedings.
8.4 No Guarantees of Detection
While we employ sophisticated Automated Systems, we make no guarantee that all prohibited Content will be detected, flagged, or removed. Automated Systems may fail to identify certain violations. The existence and deployment of Automated Systems do not create any obligation to monitor or remove specific Content.
8.5 User Responsibility
Notwithstanding the deployment of Automated Systems, you remain personally responsible for all Content you create, upload, or transmit on the Platform. You agree not to rely solely on Automated Systems to prevent illegal or harmful Content from being distributed.
9.1 Platform Monitoring
RenterFinder may monitor User communications, transactions, and activities on the Platform to ensure compliance with this Agreement, applicable law, and Platform policies. Monitoring is conducted through both automated systems (as described in Section 8) and, where necessary, human review by our expert team.
9.2 Chat and Messaging Monitoring
Direct messages and chat communications between Users are subject to automated and manual monitoring. We may review, flag, or remove messages that contain prohibited Content, scams, harassment, or violations of applicable law.
9.3 Message Moderation Standards
Messages may be flagged or removed if they contain:

Communications containing evidence of illegal activity (fraud, harassment, threats, etc.) may be escalated to law enforcement authorities without notice to the User.
10.1 Privacy Policy
Your use of the Platform is subject to our Privacy Policy, which is incorporated by reference into this Agreement. The Privacy Policy describes our data collection, processing, and use practices. Please review the Privacy Policy carefully.
10.2 Personal Data Processing by Automated Systems
RenterFinder processes Personal Data (as defined under the Digital Personal Data Protection Act, 2023) through Automated Systems for content moderation, fraud detection, and user safety purposes. This processing of Personal Data through Automated Systems is conducted pursuant to RenterFinder's legal obligations under:
10.3 DPDP Act Section 7 Exemption
The processing of Personal Data through Automated Systems for content moderation and user safety constitutes "certain legitimate uses" under Section 7(a) of the Digital Personal Data Protection Act, 2023. Accordingly, separate explicit consent from Users is not required for such processing. Your continued use of the Platform constitutes acknowledgment and implied consent to the processing of your Personal Data through Automated Systems for the purposes outlined herein.
10.4 Data Subject Rights
Subject to applicable law, Users may have rights including access, correction, erasure, and data portability. Such requests should be directed to our Data Protection Officer (contact information in Section 22). We shall respond to valid requests within timeframes prescribed by law.
10.5 Data Retention
We retain Personal Data for as long as necessary to provide Services, comply with legal obligations, or resolve disputes. Data may be retained in anonymized or de-identified form for analytical purposes.
10.6 Data Security
We implement industry-standard security measures to protect Personal Data. However, no system is completely secure, and we cannot guarantee absolute security of data transmitted over the internet.
10.7 International Data Transfers
If Personal Data is transferred outside India, such transfer shall be conducted in compliance with applicable data protection laws.
11.1 Fee Structure
RenterFinder charges the following fees (inclusive of all taxes) for its Services:
11.2 Refer & Earn Program
The Refer & Earn program allows Users to earn rewards for referrals. Specific terms of the Refer & Earn program are published separately on the Platform. Earnings from referrals are at RenterFinder's sole discretion and may be modified or terminated without notice.
11.3 Payment Methods
Payments must be made through authorized payment methods made available on the Platform (credit cards, debit cards, digital wallets (UPI), bank transfers, etc.). All payments are processed by third-party payment gateways. Your payment information is subject to the payment gateway's terms and privacy policy.
11.4 Tax Responsibility
You are responsible for all applicable taxes (GST, income tax, etc.) related to fees paid or earned on the Platform. RenterFinder will issue tax documents (invoices, TDS certificates) as required by law.
11.5 Non-Refundable Fees
All fees charged by RenterFinder are non-refundable unless otherwise required by law. Profile Listing Fees, Platform Service Fees, and Re-activation Fees are non-refundable under all circumstances.
11.6 Fee Modifications
RenterFinder reserves the right to modify fees at any time. Changes will be communicated on the Platform instantly. Continued use of the Platform after such notice constitutes acceptance of modified fees.
11.7 Failed / Duplicate Payments
If a fee payment fails, your account access may be restricted or suspended until payment is successfully processed. In case of duplicate payment, you must notify us within 48 hrs of the transaction at report.renterfinder@gmail.com providing full transaction details and supporting documents. Upon verification, approved refunds will be processed within 15 working days to the original payment method, subject to bank processing timelines.
11.8 RWA Partnership Program
Special fee structures may apply to Residence Welfare Associations participating in our partnership program. Terms of such partnerships are governed by separate agreements.
12.1 General Limitation
Except as expressly provided otherwise in this Agreement or as required by law, in no event shall RenterFinder, its officers, directors, employees, agents, licensors, or service providers be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, even if RenterFinder has been advised of the possibility of such damages.
12.2 Cap on Liability
In no event shall RenterFinder's total cumulative liability to you arising out of or related to this Agreement, the Platform, or the Services exceed the lesser of:
This cap applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) on which the claim is based.
12.3 Automated Systems Liability Shield
RenterFinder, its officers, directors, employees, and agents shall bear no liability whatsoever for:
12.4 Intermediary Safe Harbour
As an intermediary under Section 79 of the Information Technology Act, 2000, RenterFinder is not liable for any third-party Content or User actions on the Platform. We do not endorse, validate, or assume responsibility for any User-generated Content, user profiles, property listings, or transactions between Users.
12.5 No Liability for Third-Party Services
RenterFinder is not liable for any services, products, or content provided by third parties integrated with the Platform (payment gateways, messaging services, property information providers, ad, sponsors, etc.). Your use of such third-party services is at your own risk.
12.6 Consequential Damages Waiver
You waive any claim for consequential, indirect, or incidental damages arising from your use of or inability to use the Platform, including damages for lost profits, loss of business opportunities, damage to reputation, or emotional distress.
13.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless RenterFinder, its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

You shall defend RenterFinder against any claim covered by your indemnification obligation and shall not settle any claim without RenterFinder's prior written consent.
13.3 Scope of Indemnification
Your indemnification obligation is not limited by the limitation of liability provisions in Section 12 and shall apply regardless of whether RenterFinder is found partially or wholly liable.
14.1 Disclaimer of Warranties
The Platform and all services, content, and features are provided "As is" and As available" without warranty of any kind, express or implied.
14.2 Implied Warranties
RenterFinder disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, and quality. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or malware.
14.3 No Warranty of Content
RenterFinder makes no warranty regarding the accuracy, authenticity, completeness, legality, or truthfulness of any User-provided Content or information, including property ownership, property profile listings, the condition of properties or communications. RenterFinder does not verify the identity of Users, personal information of renters, renter's profile, rental terms, or any other information provided by Users.
14.4 User Responsibility for Verification
You are solely responsible for independently verifying all information on the Platform, including property details, user identities, and transaction terms. Do not rely solely on Platform information for rental or property decisions.
14.5 No Professional Advice
The Platform and any educational content (blog posts, guides, etc.) are provided for informational purposes only and do not constitute legal, financial, tax, or real estate advice. Consult appropriate professionals (lawyers, accountants, real estate agents) before making rental or property decisions.
14.6 Exclusion of Warranties
To the fullest extent permitted by law, any warranty or representation not expressly stated in this Agreement is excluded.
15.1 Deactivation by RenterFinder
RenterFinder may terminate, suspend, or restrict your account access at any time for any reason or no reason, with or without cause, with or without notice. Grounds for termination include but are not limited to:
15.2 Immediate Suspension for Illegal Activity
If we have reasonable grounds to believe your account is being used for illegal purposes, we may immediately suspend or terminate your account without notice or opportunity to cure.
15.3 Deactivation by User
You may deactivate your account by yourself at any time. You may also request account deactivation by contacting report.renterfinder@gmail.com. Your deactivation request will be processed within 7 business days.
15.4 No Refund Upon Deactivation
Deactivation does not entitle you to refund of any fees paid. Fees are non-refundable under all circumstances.
15.5 Reactivation
Deactivated accounts may be re-activated (within 6 months) only with RenterFinder's written consent and payment of the Re-activation Fee (₹99).
16.1 Third-Party Links
The Platform may contain links to third-party websites, applications, and services. RenterFinder is not responsible for the content, accuracy, safety, or functionality of third-party links. Your use of third-party services is governed by their respective terms and privacy policies.
16.2 No Endorsement
RenterFinder does not endorse or assume responsibility for any third-party products, services, or content. The inclusion of links does not imply affiliation or endorsement.
16.3 Third-Party Content
The Platform may include content provided by third parties (property information, market data, reviews, etc.). RenterFinder is not responsible for the accuracy or completeness of such content.
16.4 User Responsibility
You are solely responsible for evaluating third-party content and services. Exercise caution and conduct your own research before engaging with third-party services or relying on third-party information.
17.1 Informal Resolution
Before pursuing formal dispute resolution, you agree to attempt to resolve any dispute informally by contacting our Grievance Officer (Section 21). We shall attempt to resolve disputes in good faith within 30 days of your complaint.
17.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement, the Platform, or the Services that is not resolved through informal resolution shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996.
17.3 Arbitration Seat
The seat of arbitration shall be Patna, Bihar. The arbitration shall be governed by the substantive law of the State of Bihar.
17.4 Arbitration Language
All arbitration proceedings shall be conducted in English unless both parties agree otherwise in writing.
17.5 Cost Sharing
Each party shall bear its own costs in arbitration, including attorneys' fees. Arbitrator fees and administrative costs shall be shared equally by both parties unless the arbitrator decides otherwise based on the merits.
17.6 Confidentiality
Arbitration proceedings and awards shall be kept confidential to the fullest extent permitted by law.
17.7 Class Action Waiver
You agree that any arbitration or lawsuit shall be conducted solely on an individual basis and not as a class action, group action, or representative action. You waive any right to participate in a class, group, or collective action against RenterFinder. Class action proceedings are prohibited.
17.8 Governing Substantive Law
This Agreement and any dispute shall be governed by and construed in accordance with the laws of the State of Bihar, India, without regard to its conflict of law principles.
18.1 Governing Law
This Agreement is governed by and shall be construed in accordance with the laws of the State of Bihar, India, without regard to its conflicts of law principles. The following statutes are particularly relevant:
18.2 Exclusive Jurisdiction
Except as provided in the arbitration clause (Section 18), you irrevocably submit to the exclusive jurisdiction of the courts of Patna, Bihar, India for any judicial proceedings.
18.3 Digital Evidence
All Content, communications, and transactions on the Platform may be admitted as digital evidence in legal proceedings under the Bharatiya Sakshya Adhiniyam, 2023 and the Information Technology Act, 2000.
18.4 Statute of Limitations
Any claim or action arising out of or relating to this Agreement must be brought within one (1) year of when the claim first arose, unless otherwise provided by law. However, claims of fraud may be brought within the period specified by applicable law.
19.1 Entire Agreement
This Agreement, including all referenced policies and guidelines, constitutes the entire agreement between you and Renter Finder regarding the Platform and Services. All prior negotiations, representations, and agreements are superseded by this Agreement.
19.2 Integration Clause
This Agreement may not be modified except by a written amendment signed by an authorized representative of RenterFinder. Representations made by RenterFinder employees or agents outside of this Agreement are not binding.
19.3 Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.
19.4 Waiver
Failure by RenterFinder to enforce any provision of this Agreement does not constitute waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized RenterFinder representative.
19.5 Cumulative Remedies
All remedies available to RenterFinder under this Agreement, at law, or in equity are cumulative and not exclusive. The exercise of one remedy does not preclude the exercise of other remedies.
19.6 No Agency or Partnership
Nothing in this Agreement creates an agency, partnership, joint venture, or employment relationship between you and Renter Finder. You are not authorized to represent, bind, or assume obligations on behalf of RenterFinder.
19.7 Independent Contractors
Landlords and Renters using the Platform are independent parties conducting their own rental transactions. RenterFinder does not employ, direct, or control Users and does not establish employer-employee relationships.
19.8 Consumer Protection Act Applicability
The Platform provides intermediary services under Section 2(7)(g) of the Consumer Protection Act, 2019. RenterFinder qualifies as an intermediary, not a service provider for the rental transaction itself. Accordingly, the Consumer Protection Act's provisions regarding service providers do not apply to RenterFinder's intermediary functions. Users must pursue rental disputes with other Users or through applicable rental laws, not through Consumer Protection Act remedies against RenterFinder.
19.9 Counter-Party Estoppel
By accepting this Agreement, you irrevocably waive any claim or estoppel that might arise from RenterFinder's prior conduct, representations, or omissions not expressly reflected in this written Agreement.
19.10 Notices
Any notice to be provided under this Agreement shall be in writing and sent to the addresses listed in Section 22 (Contact Information). Notices are effective upon receipt.
19.11 Assignment
RenterFinder may assign this Agreement to any successor or affiliate. You may not assign this Agreement without RenterFinder's written consent.
19.12 Amendment of Terms
RenterFinder reserves the right to amend this Agreement at any time. Amendments become effective when posted on the Platform. Your continued use constitutes acceptance of amended terms.
19.13 Force Majeure
RenterFinder is not liable for failure to perform obligations under this Agreement due to events beyond reasonable control, including but not limited to natural disasters, pandemics, epidemics, wars, terrorism, government orders, sanctions, internet shutdowns, acts of god, or other force majeure events. During force majeure events, the Platform may be unavailable or service may be interrupted.
19.14 Electronic Communications
By accessing the Platform, you consent to receive electronic communications from RenterFinder, including notices, policy updates, and account communications. Electronic communications satisfy any legal requirement for written communications.
19.15 Relationship with Users
RenterFinder does not control User behavior or interactions. We are not responsible for injuries, property damage, financial loss, or any other harm arising from interactions between Users.
20.1 Grievance Officer Appointment
In compliance with the IT (Intermediary Guidelines) Rules, 2021, RenterFinder has appointed a Grievance Officer to receive and respond to complaints from Users regarding Platform operations, content moderation, data protection, and alleged violations of this Agreement.

20.3 Complaint Information Requirements

20.6 Appeal Process
If you are dissatisfied with the Grievance Officer's response, you may appeal within 30 days by providing written details of your dissatisfaction. The appeal will be reviewed by senior management.
20.7 Automated Systems Appeal
If your Content was flagged, removed, or your account was restricted by Automated Systems, you may appeal the decision through the grievance mechanism. Manual review by the Grievance Officer shall be provided, and the decision may be overturned if the Automated Systems decision is found to be erroneous.
20.8 No Waiver by Complaint Process
Using the complaint mechanism does not waive your right to pursue arbitration (Section 18) or other legal remedies.
